Article 1 – Seller
These general terms of sale apply to sales of original works concluded by:
Laurent Perazza, artist-author (painter)
Address: 312 Route de la Berthomelière, 85440 Poiroux, France
Micro-entrepreneur (French sole trader)
SIRET: 98314552500017
APE code: 4778C
Email: contact@laurentperazza.art
Phone: +33 6 59 69 68 98
Article 2 – Scope
These terms apply to every sale of an original work (paintings and other unique pieces) concluded at a distance, through the website or after an exchange by email, phone or messaging, as well as to sales concluded at the studio. They apply to private buyers (consumers) and to professional buyers, subject to the specific rules for each set out below. They prevail over any other document unless otherwise agreed in writing.
Article 3 – Works
Each work is a unique piece, signed by the artist. Photos and descriptions (title, technique, dimensions, year) are as faithful as possible. Slight colour differences may occur depending on the screen used; these do not constitute a lack of conformity.
Article 4 – Prices and offer
Prices are not displayed on the website; they are available on request. Before any sale, the artist sends the buyer a written offer specifying the work, the price, delivery and insurance costs, timeframes and the period of validity of the offer.
Prices are stated in euros. VAT not applicable – article 293 B of the French General Tax Code.
Article 5 – Ordering
The buyer contacts the artist (contact form, email or phone). After discussion, the artist sends the written offer. The sale is concluded as soon as the buyer accepts the offer in writing (an email is sufficient). The artist then issues an invoice and confirms the sale by email (durable medium).
Article 6 – Payment
Payment is made by SEPA bank transfer to the bank details shown on the invoice (which may include a SEPA QR code). Unless otherwise agreed in writing, payment is due within 3 days of the invoice date. The work is reserved for the buyer during this period. If payment is not received in time, the artist may cancel the sale after one unanswered reminder.
Article 7 – Retention of title
The work remains the property of the artist until the price has been paid in full. The work is shipped or handed over only once full payment has been received.
Article 8 – Delivery, packaging and insurance
Delivery options: collection in person at the studio, shipping by carrier, or a specialist fine-art carrier, depending on the work and the destination. Areas served: Europe and the United States.
Delivery and insurance costs: calculated according to the size and weight of the work and the destination. They are always shown in the offer and on the invoice.
Delivery time: as stated in the offer. Unless agreed otherwise, the work is delivered no later than 30 days after the sale is concluded (article L216-1 of the French Consumer Code).
Article 9 – Receipt and transfer of risk
For a consumer buyer, the risk of loss or damage passes to the buyer when they (or a person they designate) take physical possession of the work (article L216-4). For a professional buyer, the risk passes on handover to the carrier.
On receipt, the buyer checks the packaging and the work, in the presence of the delivery person if possible. In case of damage, the buyer records precise reservations on the delivery note, takes photos and informs the artist within 48 hours at contact@laurentperazza.art. For a professional buyer, reservations must be confirmed to the carrier within 3 days (article L133-3 of the French Commercial Code).
Article 10 – Right of withdrawal
For a distance sale, the consumer buyer has 14 days from receipt of the work to withdraw, without giving any reason (article L221-18 of the French Consumer Code).
To exercise this right, the buyer sends a clear statement before the deadline to contact@laurentperazza.art or by post, for example using the form below. The buyer then returns the work, in its original packaging and in good condition, no later than 14 days after the statement. Return costs (transport and insurance) are borne by the buyer. The artist refunds all sums paid, including the initial delivery costs (based on the standard method), within 14 days of the withdrawal, and may wait until the work, or proof of its dispatch, has been received. The refund is made by bank transfer. The buyer remains liable for any depreciation of the work resulting from handling beyond what is needed to examine it.
No right of withdrawal applies in the following cases:
- works made to order, to the buyer's specifications, or clearly personalised (article L221-28, 3°);
- sales concluded at the studio, or with both parties physically present: these are not distance sales;
- professional buyers purchasing in the course of their business.

Article 11 – Legal guarantees
For consumer buyers, the artist is bound by the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code).
Guarantee of conformity: the buyer has 2 years from delivery to act. The buyer may request repair (restoration) of the work; as a unique work cannot be replaced, if repair is impossible the buyer may obtain a price reduction or cancellation of the sale with a refund against return of the work. During these 2 years, the buyer does not have to prove that the defect existed at delivery.
Guarantee against hidden defects: the buyer has 2 years from discovery of the defect and may choose between cancellation of the sale or a price reduction.
Natural ageing of materials and damage caused by poor conservation (direct light, humidity, heat) are not covered.
Article 12 – Certificate of authenticity
Each work comes with a certificate of authenticity signed by the artist.
Article 13 – Copyright and reproduction
The purchase transfers ownership of the physical work, not the copyright (article L111-3 of the French Intellectual Property Code). Laurent Perazza retains all reproduction and representation rights, as well as his moral right. The buyer may not reproduce the work (prints, merchandise, commercial use, NFTs, etc.) without the artist's written consent, but may photograph it for strictly private use. The artist may reproduce the work for his own communication (website, catalogue, social media, exhibitions).
Article 14 – Resale right
If the work is later resold by an art market professional (gallery, auction house, dealer), the artist is entitled to the resale right provided for in article L122-8 of the French Intellectual Property Code, where the resale price is at least €750. This royalty is payable by the professional seller. It does not apply to the first sale by the artist or to resales between private individuals.
Article 15 – Works in galleries
Some works are exhibited at or deposited with partner galleries, as indicated on each artwork page, and can be viewed there. A work in a gallery may be sold by the gallery at any time; its availability is confirmed in the offer. If a work is purchased from a gallery, that gallery's terms of sale apply.
Article 16 – Personal data
Laurent Perazza is the controller of the data collected (name, contact details, messages, billing data). It is used to answer enquiries, prepare offers and invoices, deliver works and meet accounting obligations (legal bases: contract, legal obligation and legitimate interest). It is never sold or rented, and is shared only with the service providers required (Shopify as host, carrier, bank). Retention period: 3 years after last contact for prospects; 10 years for accounting records. Under the GDPR, you have the right to access, rectify, erase, object to, restrict and port your data by writing to contact@laurentperazza.art. You may also lodge a complaint with the CNIL (www.cnil.fr).
Article 17 – Complaints and consumer mediation
Any complaint must first be sent to the seller in writing: contact@laurentperazza.art or by post to the address given in article 1.
In accordance with articles L612-1 et seq. of the French Consumer Code, if the dispute could not be settled through this prior written complaint, the consumer may refer the matter, free of charge, to the following consumer mediator, within one year of the written complaint to the seller:
CM2C – Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, France – Email: contact@cm2c.net – Phone: +33 1 89 47 00 14 – Website: https://www.cm2c.net
The dispute can be filed directly on the CM2C online platform: https://www.cm2c.net, or by post to the address above.
The European Commission also provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr.
Article 18 – Governing law and disputes
These terms are governed by French law. In a dispute with a consumer, the consumer may bring proceedings before the court of their place of residence or of the place of delivery. For a professional buyer, the courts with jurisdiction are those of the artist's place of residence. A consumer residing in another EU country retains the protection of the mandatory rules of their country.
